AUCTION LOCATION: Cambridge Community Building, 722 Patterson (two blocks north of Highway 6&34 in downtown Cambridge Nebraska)

 

LAND LOCATION: 

Tract One: 2.5 miles west of Wilsonville NE at the junction of Highway 89 and Highway 47 (east of Highway 47 ROW and north of railroad ROW).

Tract Two: 2.5 miles east of Lebanon NE to Rd 406, south on Rd 406 3.5 miles to Rd 702, east 2 miles on Rd 702 to the southwest corner of tract 2 (borders the Kansas State Line and Red Willow County NE line).

Tract Three: 5 miles north of Lebanon NE on Dr 403 and Rd 403 to Rd 710, turn east on Rd 710 1.75 miles to the north west corner.

 

LEGAL DESCRIPTIONS:

Tract One: Part of the SW1/4 sec. 28-T2N-R25W Furnas County NE, lying north of the railroad right of way, containing 126 +/-  acres.

Tract Two: W1/2 & W1/2 E1/2 of sec. 31-T1N-R25W Furnas County NE, containing 453 +/- acres.

Tract Three: W1/2 NW1/4 sec. 27 & E1/2 NE1/4 sec. 28 all in T2N-R26W, Red Willow County NE containing 160 +/- acres.

 

POSSESSION:

Tracts One and Two: Landlord’s possession on the date of closing, full possession March 1, 2013.

Tract Three: Landlord’s possession on the date of closing, full possession March 1, 2014.  Buyer will assume the existing written cash lease ending February 28, 2014 and receive the 2013 cash rent of $4,500 payable in two installments.

 

MINERAL RIGHTS:

Tracts One and Three: Sellers reserve 50% of any owned mineral rights for 20 years, or until production ceases, with leasing and income rights.

Tract Two: Has existing oil production; sellers reserve 100% of mineral rights and royalty income until all production ceases on tract two.

 

PROPERTY AND OCCUPATION TAXES: The seller will pay all 2012 and previous years’ real estate and NRD occupation taxes.  The buyer will pay all 2013 and subsequent years real estate and occupation taxes.

 

ASSESSOR INFORMATION:

Tract One: 126 tax assessed acres, 2011 Furnas County real estate taxes $3,604.86 plus NRD occupation tax of $1,240.

Tract Two: 453 tax assessed acres, 2011 Furnas County real estate taxes $4,031.38.

Tract Three: 160.14 tax assessed acres, 2011 Red Willow County real estate taxes $1,390.88

 

GENERAL INFORMATION:

Tract One: Beaver Valley bottom land lying near level with very productive soils.  124 certified irrigated acres in the Lower Republican NRD.  Excellent location, at the junction of two paved highways and close to markets.  FSA information shows 105.21 acres of growing alfalfa and 19.72 of wheat stubble which has been sprayed by the tenant.  GW and NRD records show the irrigation well was drilled in 1955 to depth of 105 feet with a pumping capacity 1,000 GPM.  The well was last used in 2004 and is reported to be inoperable.  The electric motor and panel box are the tenant’s property.  The irrigation well is being sold in as-is condition and does not include any of the electrical components.

Tract Two: A combination dry land farm located in the southwest corner of Furnas County with productive soils typical of the area.  FSA information shows 203.86 acres of cropland; 185.05 currently in corn stalks and 18.81 in grass and currently pastured.  243.29 acres are in grass, which is mostly fenced pasture, watered by a windmill and submersible well.  The fences are serviceable, in average condition.  There is no CRP contract in effect so the above 18.81 acres in grass could be easily tilled.  Three of the tanks at the windmill and the tank and timer on the submersible well are the property of the tenant and are not included.  There are producing oil wells on this property.

Tract Three: 160 acres in Southeastern Red Willow County with productive soils typical of the area.  FSA maps and records show 97.2 acres currently in summer fallow and 64 acres of unfenced grass and wildlife habitat.  Some of the grass lays good and could easily be converted to cropland.

 

CONDITIONS: Subject to deed restrictions, zoning regulations, easements, agreements of record, and oil and gas leases or agreements pertaining to oil and gas production.  The property may contain noxious weeds or animals.  The descriptions and measurements of the property are deemed to have come from reliable sources but are not guaranteed by the broker or seller.  FSA information, base acres, and yields are not guaranteed.  Any maps provided are to be used for a general guideline and do not guarantee property lines or acres.  Sells subject to the rules and regulations of the Lower Republican NRD (tracts one and two) and the Middle Republican NRD (tract three).

 

TERMS: The successful buyers will enter into a written purchase agreement with a 10% earnest money deposit in good funds or a cashable check immediately after the auction.  The balance of the purchase price will be due at closing on or before December 20, 2012.  The closing to be conducted by Downing, Alexander & Wood in Kearney Nebraska.  Seller will provide a marketable title to the buyer evidenced by a policy of title insurance.  Cost of the owner’s title insurance and escrow agents fees to be divided equally between the seller and buyer.  Landlord’s possession will be on the day of closing with full possession March 1, 2013 on tracts one and two.  Full possession of tract three will be March 1, 2014 with the buyer to receive all the cash rent due in 2013.  The seller will pay all the 2012 real estate taxes and NRD occupation tax, the buyer will pay all the 2013 real estate taxes and NRD occuption tax due in 2013 and subsequent years.  The property will not be sold subject to financing or inspections.  Please have all financial arrangements and inspections made prior to the auction.  All announcements made the day of the auction will take precedence over any statements, written, oral, or implied.  Vontz Realty and Double E Land Brokers LLC are working for the seller as a seller’s agent.  The property is being sold in as is condition with no warranty expressed or implied.  All prospective buyers should fully iinspect the property and rely on their own conclusion.
